PRIVACY POLICY
Updated January 4, 2008
REACT Systems, Inc. has adopted a set of Privacy Principles and has implemented those Principles in this Privacy Policy (the “Policy”), which describes how we collect, use, and share personally identifiable information (information that can be used to identify you, such as our full name, email address, mailing address, or telephone number) (“PI”) we obtain from and about individuals located in the U.S. both on-line and off-line.
This Policy applies to all RS Sites and services owned or provided by REACT Systems, including its subsidiaries (collectively “RS Sites”). New RS Sites, domain names, or services that we add to the RS Sites will be subject to this Policy.
The RS Sites are general audience web sites, and REACT Systems does not knowingly collect PI from children under 13 years of age.
From time to time we may revise this Policy to reflect industry initiatives or changes in the law, our information collection and use practices, the features of the RS Sites, or technology. If we make revisions that change the way we collect or use your PI, those changes will be posted in this Policy and the update date will be noted at the beginning of this Policy. Therefore, you should review it periodically so that you are up to date on our most current policies and practices. If we materially change our practices regarding use of your PI, your PI will continue to be governed by the Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.
General. REACT Systems collects PI in order to create or enhance our relationship with you. When we collect PI form you it is because you are voluntarily submitting the information to use in order for you to participate in certain activites including (i) registration for certain online services; and (ii) subscription registration. If REACT Systems obtains PI from a third party, such as a channel partner, our use of that information is governed by this Policy.
We may contact you regarding account status, changes to this Policy, our User Agreement or other terms of use, to confirm your registration, for customer service purposes or for any other business reason related to your use of RS Sites.
Provided you have given us consent, REACT Systems may also share your PI with business and channel partners that are not affiliated with REACT Systems, but would like to send you information about their products and services. In the event that you terminate your customer relationship with us, or become an inactive customer, REACT Systems will continue to adhere to the policies and practices described in his Policy.
REACT Systems does not guarantee or warrant the RS Sites will be uninterrupted, without delay, error-free, omission-free, or free of viruses. Therefore, the information is provided "as is" without warranties of any kind, express or implied, including accuracy, timeliness and completeness. In no event shall REACT Systems, its executives, delivery management, delivery staff, or employees be liable for any direct, indirect, incidental, special, exemplary, punitive, consequential or other damages whatsoever (including, but not limited to, liability for loss of use, data or profits), without regard to the form of any action, including but not limited to contract, negligence or other tortuous actions, arising out of or in connection with the RS Sites, any content on or accessed by use of the RS Sites, or any copying, display or other use hereof.
Content on the RS Sites is copyrighted; any unauthorized use of any materials on the RS Sites may violate copyright, trademark and other laws. Should a user or customer download the materials on the RS Sites for personal or non-commercial use, the user or customer must retain all copyright, trademark or other similar notices contained in the original materials on any copies of the material. Materials on the RS Sites may not be modified, reproduced or publicly displayed, performed or distributed or used for any public or commercial purposes.
Third party links may be provided as a convenience to our users. REACT Systems does not control and is not responsible for any of these web sites or their content. REACT Systems is not responsible for the privacy practices or the content of these other web sites. We encourage you to review the privacy policies posted on these third-party web sites. REACT Systems is obligated to protect its reputation and trademarks and REACT Systems reserves the right to request removal of any link to our RS Sites.
Collection of Information. When you visit our RS Sites, we collect, retain and use non-public personal information about our potential, current and former users and customers as follows:
Personal information that you knowingly supply to us. When you sign up for our products and services or register on our RS Sites to access our product demo, REACT Systems will collect personal information that will help us to identify you, authenticate you, and provide you with better service. Examples of such personal information are: user or customer name, address, telephone number, email address, and customer number. We will not sell, lease, disclose or trade your PI to any third party, except, there may be instances when REACT Systems may disclose PI without providing you with a choice in order to protect the legal rights of REACT Systems, their employees, agents and contractors, to protect the safety and security of visitors to the RS Sites, to investigate, prevent or protect against suspected fraud, illegal or legal process, or to establish or exercise our legal rights or defend against legal claims. In addition, if REACT Systems sells all or part of its business or makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, REACT Systems may transfer your PI to a third party as part of that transaction. Because of the uncertain regulatory environment associated with privacy issues, we may also be forced to disclose PI to the government.
Protection of Information. The protection of PI is of utmost importance to us. REACT Systems employees, agents, and contractors are required to have a legitimate business reason to obtain access to your PI. REACT Systems may share your PI with outside contractors or agents who help us manage our information activities but they must have agreed only to use your PI to provide REACT Systems with a specific service and not for any other reason. It is possible, however, that electronic communications may be accessed by unauthorized third parties when communicated between you and REACT Systems or any other electronic means.
REACT Systems uses reasonable administrative, technical, personnel, and physical measures to safeguard PI in its possession against loss, theft and unauthorized use, disclosure or modification. Passwords and other sensitive information stored by REACT Systems are encrypted in transit.
Notwithstanding these security measures, please be aware that when you submit PI to the RS Sites over the Internet, the information may travel over many systems that are not under REACT Systems’ control and may not be secure.
If a password is used to help protect your PI, it is your responsibility to keep you password confidential. Do not share this information with anyone. Anyone who has access to your password will have access to your PI.
